HIPAA calls for criminal penalties as well as fines for wrongful disclosure of individual health information (e.g., selling, transferring, or using data for commercial advantage or personal gain). Fines for non-compliance with the requirements are $100 per violation to a maximum of $25,000 per requirement per year. Wrongful disclosure of Health Information ranges from simple disclosure fines of $50,000 and/or one year in prison, up to $250,000 with criminal penalties as severe as imprisonment for up to ten years for disclosures with intent to sell or use protected health care information. Perhaps, however, the greatest threat might be the refusal of the Health Care Financing Administration (HCFA) to approve any payment requests made by a non-compliant or negligent organization.
